Thomas Markle Sr, the 82-year-old estranged father of Meghan, Duchess of Sussex, has been arrested by the FBI in Florida on a federal charge of possessing child sexual abuse material.

Agents arrested him on Friday, 6 November, at Maravida Senior Living, a care home in North Lakeland, Florida, where he lives. Prosecutors say the case centres on material found in two storage units he rented in the Los Angeles area for almost 20 years.

He faces one count of possession of child pornography. If a court finds him guilty, he could be jailed for up to 20 years in a federal prison. No plea has been entered yet. A charge is an accusation, not a verdict — a court still has to decide whether he is guilty.

Arrest and Federal Charge

FBI Director Kash Patel said officers “moved quickly” to arrest Markle. In a statement, Patel said: “Mr. Markle allegedly targeted innocent children and sought to steal their innocence through his criminal actions.” He added that the FBI would “use every single resource at our disposal to protect innocent kids”.

First Assistant US Attorney Bill Essayli, one of the prosecutors in the case, said: “These allegations are extremely serious, and we will prosecute Mr. Markle to the fullest extent of federal law.”

A federal charge means the case is brought by the United States government, not by one state. The charge was filed as a criminal complaint in a federal court in Los Angeles. That is the first formal step in a case. It does not mean the person is guilty. The court hears the evidence and then decides.

The Daily Mail was the first outlet to report the arrest.

The FBI searched the two Los Angeles storage units last week after getting court warrants. Agents seized about 78 items, including photographic slides, 35mm film negatives and books. Prosecutors say the items contain child sexual abuse material. Markle rented the units since 2008, and the last payment was made in October this year, the BBC reported.

Investigators say witnesses identified Markle in two of the images. In those pictures, the man looks to be in his 30s or 40s. That suggests the alleged abuse dates back decades, because Markle is now 82.

The case began in the Philippines. Police there opened an investigation after a person found suspected material among Markle’s belongings and signed a formal statement about it in October. Markle’s son, Thomas Markle Jr, 60, said he found boxes of material at his father’s home in Cebu and handed them to the police. Four boxes — holding computers, phones, hard drives and old video tapes — were given to officers. Philippine officials named Markle Jr a “person of interest” in their inquiry. That does not mean he is a suspect.

Markle moved to the Philippines last year after a series of strokes. He lived in Cebu until May this year. He then moved to a rehabilitation centre in Florida, where he was learning to walk again after having a leg amputated.

In October, the FBI said it knew about the claims and would support the Philippine authorities and look into any offences under US federal law.

Markle denies the claims. He has called them “sick lies”. He told the Daily Mail he had paid for sex in the Philippines, but said he had never been with anyone under the age of 18.

Court Hearing and Release Terms

Markle appeared in court in Tampa, Florida, on Friday. The hearing lasted about 30 minutes. He was brought into the courtroom in a wheelchair, escorted by two US Marshals. He wore black trousers and a black T-shirt.

Federal prosecutor Courtenay Derry laid out the charges against him, CBS News reported.

The court ordered Markle to stay at home at his care facility in Florida — a condition known as home detention — and to wear an electronic monitor. He is not allowed to travel outside two court areas: the Middle District of Florida and the Central District of California.

No plea was entered at the hearing. That means Markle has not yet said whether he pleads guilty or not guilty. A date for his next court appearance in California, called an arraignment, will be set later.

Why This Case Matters

Thomas Markle is the father of Meghan, the wife of Britain’s Prince Harry. The two have been estranged since 2018, and Meghan broke off contact with him. His arrest has drawn wide attention because of that family link — and because the charge involves alleged crimes against children.

In a statement in October, after the claims first became public, Meghan said she was “deeply distressed” and called the claims “sickening”. She said she first learned of “disturbing allegations” against her father in 2019, and that she had cut ties with him to protect her children, Prince Archie, 7, and Princess Lilibet, 5. “My thoughts are with any children who may have been harmed,” she said.

After the arrest, the Duchess of Sussex had no comment. Buckingham Palace also had no comment and pointed questions to the Sussexes.

The case will now move through the US courts. The next step is the arraignment in California, where the complaint was filed. If the case goes to trial, a judge or jury will weigh the evidence — including the seized items and witness accounts — and decide the verdict. Until then, Markle is presumed innocent under US law. That means the law treats him as not guilty unless a court proves otherwise.
